court on Thursday ruled that the controversial trademark registered by Qiaodan Sportswear Co infringed upon US basketball star Michael Jordan's prior trademark rights and violated the country's Trademark Law.


The Supreme People's Court (SPC) on Thursday also ordered the Trademark Appraisal Committee (TAC) of the State Administration for Industry and Commerce to reconsider its decision on the trademark dispute Men's Nike Air Force One High White Black Sale , after the SPC overruled two previous decisions, reported the China News Service.


According to the SPC, the evidence was sufficient to prove that the Chinese translation of the name of Michael Jordan enjoys a high level of popularity and the registration of the trademark of the Fujian Province-based Qiaodan Sportswear was done with obvious subjective malice.


Furthermore, the court also found the Fujian company's advertisements and applications of the trademark and the company's name are insufficient to render the disputed trademark legitimate Nike Air Force One Low Men's White Blue Sale , according to the China News Service.


Jordan has accused Qiaodan Sportswear of using his name without authorization, as he believes "Qiaodan" to be a Chinese transliteration of "Jordan," but the TAC rejected Jordan's 2012 demand to overturn the company's trademark, the Global Times previously reported.
